What a spousal buyout mortgage is
A spousal buyout mortgage (sometimes called a separation buyout or matrimonial home buyout) is a refinance structured so that:
- One spouse keeps the home
- The other spouse is paid their share of the equity and removed from title
- The mortgage is rewritten (or replaced) so it fits one borrower going forward
It is not the same as a regular cash-out refinance for renovations or debt. Lenders and insurers treat buyouts differently in many cases — including how much of the home’s value you may be able to borrow — which is why “I already asked my bank” is often an incomplete answer.

Can I borrow more than a normal refinance for a buyout?
In many Ontario buyout situations, lenders and insurers look at different rules than a standard cash-out refinance. Some files can support a higher loan-to-value than a typical refinance cap — subject to program rules, documentation, and approval (O.A.C.). This is one of the first things we check so you are not planning around the wrong ceiling.
Do I need a separation agreement before I talk to a mortgage agent?
You do not need every line signed before a first conversation. You will need clear legal direction before funding — especially around the buyout amount, debts, support, and who stays on title. I coordinate with your lawyer so the mortgage plan and the agreement match.
What happens to the existing joint mortgage?
